The 3rd party administrator, Simpluris, has confirmed that checks were mailed to class members on 5/01/2017. If you have not received your check, please call (888) 369-3780 for assistance. Please understand that our firm is unable to provide detailed information over the phone, including address check was sent to, tracking information or individual settlement amounts. Each class member’s recovery will vary and is generally based on the number of hours worked and the rate of pay received during the class period.

The Notice of Class Action Settlement was sent to class members in November, 2016.

On 11/03/2016, the Court entered the Order Amending Settlement Schedule. Current and former Prospect employees who are recognized by Prospect to be members of the Class will receive a “Class Notice” via mail by early December (30 days from entry of the Order.) Simpluris, Inc., the appointed Claims Administrator, will send these notices. Only after the Court approves final settlement at a hearing currently scheduled in front of the Honorable Robert S. Lasnik on 3/02/2017 will settlement funds be disbursed to Class members.

Prospect has provided a list of employee numbers for current and former employees that it acknowledges are part of the class and entitled to back pay for the years reflected. This list is in numerical order and is searchable, to determine whether you are a class member. If your employee number appears on the list for ALL years for which you were paid less than the minimum wage, and your mailing address has NOT changed since you worked for Prospect, no action is required.

On 9/06/2016, the Court entered the Order Lifting Stay, Granting Plaintiffs’ Motion for Class Certification and Preliminarily Approving Class Action Settlement.
